The Blockchain Association and the DeFi Education Fund have filed a brief in the Tornado Cash case, supporting the plaintiff’s motion for a partial summary judgment against the United States Treasury Department. The plaintiffs filed the lawsuit after the Treasury’s Office of Foreign Assets Control (OFAC) placed addresses allegedly linked to the Tornado Cash cryptocurrency mixer on its Specially Designated Nationals and Blocked Persons List, making it illegal for US persons to interact with those addresses.
The advocacy groups argued that the OFAC sanctions could set a dangerous precedent and violate users’ rights to free speech and due process. They also reiterated that Tornado Cash is software and serves an important function in preserving user privacy, and that OFAC should sanction the people committing illicit activities rather than the neutral tools used. Coin Center also sued the same parties over Tornado Cash’s sanctioning in October.
